NormBIM ("the Service") is an automated BIM analysis platform that analyzes technical drawings and provides BIM models, norm validation reports, and related outputs.

2. Credits and pricing

• The Service operates on a credit system. Each analysis costs 1 credit.
• Credits are purchased via Stripe. All prices are in EUR, excluding VAT. VAT is calculated automatically based on your location.
• Credits do not expire.
• 3 free analyses are available without an account (trial).

3. Right of withdrawal and refund policy

EU consumers: You have a 14-day right of withdrawal from the date of purchase (Art. 6:230o BW / EU Directive 2011/83/EU).

• Unused credits: Full refund within 14 days of purchase, no questions asked.
• Used credits: By using a credit (performing an analysis), you consent to immediate performance of the digital service and acknowledge that you lose your right of withdrawal for that credit (Art. 16(m) Consumer Rights Directive). You will be asked for explicit consent before your first analysis.
• Contact info@normbim.com for refund requests.

Withdrawal form: To exercise your right of withdrawal, send a clear statement (e.g., email) to info@normbim.com with your name, purchase date, and reason. We will process the refund within 14 days using the same payment method.

4. Accuracy, disclaimer, and liability

• Analysis results depend on the quality and completeness of the uploaded drawing.
• Norm validation is based on detected elements and may be incomplete or incorrect.
• Sharp Tech B.V. is not liable for decisions made based on NormBIM outputs.
• B2B customers: Maximum liability is limited to the total amount paid in the preceding 12 months.
• Consumers: Nothing in these terms limits liability for willful misconduct or gross negligence. Your mandatory consumer rights under applicable law are not affected.

5. Intellectual property

• Your uploaded drawings remain your property.
• We do not claim ownership over your drawings or analysis results.
• We do not use your drawings to train AI models.
• The NormBIM software, interface, and algorithms are the property of Sharp Tech B.V.

6. Acceptable use

You agree not to:

• Use the Service for illegal purposes
• Attempt to reverse-engineer or copy the Service
• Upload malicious files or attempt to compromise the system
• Exceed rate limits or circumvent trial restrictions
• Resell access without written permission from Sharp Tech B.V.

7. Availability

We aim for high availability but do not guarantee uninterrupted service. We are not liable for temporary unavailability due to maintenance, updates, or circumstances beyond our control.

8. Governing law and disputes

These terms are governed by the laws of the Netherlands.

Business customers: Disputes will be submitted to the competent court in the district of Noord-Holland.

EU consumers: You may also bring proceedings in the courts of your country of residence. Nothing in these terms affects your mandatory consumer rights under applicable national law. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.

9. Changes

We may update these terms. Material changes will be communicated via the website at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
